[79] A Study on the background of the Separation between City Planning Act and Building Act in the Legislation of Republic of Korea and Republic of China on Taiwan

This study analyzed the background of the separation between city planning act and building act in the legislation of South Korea and Taiwan after World War II. Due to the introduction of the Japanese Building Standard Law, the City Planning Act and the Building Act were separated in Republic of Korea. In the Republic of China, which governed Taiwan, existing City Planning Act and Building Act worked. Taiwan City Planning Order was operated as their enforcement order and then absorbed in existing legal systems. This study concludes that there is a limit to discussing superiority or inferiority only in the form of integration or separation of city planning act and building act.
