This paper aims to show how we can utilize unexplored data for law and judicial decisions. First, I show judges and legal scholars in Japan rely on “common sense” arbitrarily to support their claim. This fact means that empirical study on unexplored data about common sense may have a significant impact on law and judicial decisions. Second, as such an empirical study, I introduce the questionnaire survey on public acceptance of AI systems. This survey shows Japanese people tend to accept AI systems when the public sector uses them. In contrast, the private sector using AI systems seems distrustful.
