This paper examines the way of examining geoscientific evidence in the civil trial for compensation for nuclear power plant and the criminal trial of TEPCO.
It can be said that the TEPCO criminal trial judgment (Tokyo District Court, September 19, 2019) found that the management had recognized the possibility of a tsunami (foresight). However, the Tokyo District Court acquitted the management of the case, saying that the long-term evaluation by the Earthquake Headquarters was based on weak grounds and unreliable. From the scientific point of view, "reliability" covered by the long-term evaluation of the Headquarters for Earthquake Research Promotion is not the concept of the property which can deny the probability of tsunami earthquake. From the viewpoint of the standard of IAEA which the Japanese government also joins, and from the viewpoint of the standard of severe accident prevention which makes it to be under 10,000 times or under 100,000 times/year = scientific and technological principle, it could not be "unexpected". It seems that the "reliability" came out by the logic which denies the countermeasure, closing the eye for the high probability.
In comparison with the judgment of civil suit for compensation for nuclear power plant, this paper examines the discussion on "reliability" and the judgment of existence of "responsibility of the state" which accepts the judgment which deviates from the scientific and technological principle of TEPCO from the geoscientific viewpoint.
